Can I Use a South Dakota or Florida Mail Forwarding Address as My State Domicile?
Many expats use a commercial mail forwarding service in South Dakota, Florida, or Texas as their U.S. domicile address because these states have no income tax and minimal residency requirements. This strategy is widely used and generally accepted, but the domicile must be legitimate, not just a mailing address (South Dakota Secretary of State: Residency Requirements).
How mail forwarding domicile works:
| State | Why Expats Choose It | Key Requirement |
| South Dakota | No income tax, no corporate tax, easy vehicle registration | Register to vote, get a South Dakota driver’s license |
| Florida | No income tax, strong homestead protections, and easy to establish | File Declaration of Domicile (Form DR-501), get FL license |
| Texas | No income tax, no franchise tax for small businesses | Get a TX driver’s license, register to vote |
Steps to establish a legitimate domicile through a mail forwarding service:
- Sign up with a registered agent that provides a physical street address (not a P.O. Box)
- Get the state’s driver’s license using the mail forwarding address (SD and FL both allow this)
- Register to vote in the new state
- Register your vehicle in the state if you own one
- Open a bank account with the new state address
- File your federal return with the new state address
- Sever all ties to your previous state (cancel old license, deregister to vote, close accounts)
Risks and limitations:
- A mail forwarding address alone is not domicile: you need the supporting actions (license, voter registration, banking) to make it stick
- Your old state may challenge it: if you only changed the address but kept a home, license, and voter registration in the old state, the old state wins
- IRS treats domicile separately: the IRS does not set domicile rules, but your state address appears on your federal return and can trigger state scrutiny
- Some banks and brokerages reject mail forwarding addresses: verify before signing up
Popular mail forwarding services for expats include Dakota Post (SD), Americas Mailbox (SD), and Traveling Mailbox (FL/TX). Monthly costs typically run $10 to $40.
