What to Put on Line 7

A defensible Kwong Line 7 narrative includes five elements:

The penalty type and statute. Example: “Refund of late-filing penalty assessed under IRC § 6651(a)(1).”
The tax year, assessment date, payment date, and amount. Example: “Tax year 2020, penalty assessed October 15, 2021, penalty paid November 20, 2021, amount paid $1,250.”
The Kwong cite. Example: “This refund is claimed pursuant to Kwong v. United States (April 2026), which held that automatic late-filing penalties assessed during the federal COVID-19 disaster period (January 20, 2020, through July 10, 2023) were not properly assessed under IRC § 7508A.”
The factual fit. Example: “The return at issue was filed on [date], within the disaster period, and the penalty was assessed automatically without IRS consideration of the disaster declaration.”
The relief requested. Example: “The claimant requests a refund of $1,250 in penalty paid, plus statutory interest under IRC § 6611.”

Keep the narrative factual, dated, and tied to the ruling. Avoid emotional language or general grievances about IRS service.

Supporting Documents to Attach

A copy of the IRS notice that assessed the penalty (CP14, CP501, CP503, or similar)
A copy of your IRS account transcript for the tax year showing the penalty assessment (transaction code 166 or 270) and the payment posting (transaction code 670)
Proof of payment: a canceled check image, a bank statement line, or the transcript payment entry

How to Mark Form 843 as a Protective Claim

If you are filing under Kwong before you have finished transcript review, before the ruling is fully resolved through any pending appeals, or before further IRS guidance arrives, file as a protective claim to preserve your refund right while the contingency works out. To do so:

Write “PROTECTIVE CLAIM” prominently at the top of Form 843, above the form title. Practitioners typically use capital letters and red ink so the IRS examiner sees it on first review.
State the protective nature on Line 7. Add one sentence to your narrative, such as: “This filing is submitted as a protective claim under Treas. Reg. § 301.6402-2(b)(1) to preserve the claimant’s right to refund pending final resolution of the contingency described above.”
File on or before July 10, 2026. A protective claim filed within the statute of limitations holds your place; one filed after does not.

A protective claim does not require complete documentation at the time of filing. It keeps the door open while you finish transcript review or wait for further guidance, and it can be supplemented or perfected later once the contingency is resolved.

Filing Mechanics for a Kwong Claim

Check the refund box on Line 5a (not the abatement box, since the penalty has already been paid). On Line 5b, enter the date you paid the penalty. Sign, date, and mail Form 843 on paper to the IRS service center listed in the form instructions for the underlying tax type, or to the address on the original IRS notice if you received one. Form 843 cannot be e-filed.

The protective-claim deadline is July 10, 2026. Filing after that risks closing off the Kwong pathway entirely, even if you would otherwise qualify.

Form 8606 reports nondeductible traditional IRA contributions, Roth IRA conversions, and distributions from IRAs with basis. Expats file it to track basis in traditional IRAs funded with nondeductible contributions and to document Roth conversion amounts (IRS: Form 8606).

When Form 8606 is required:

Nondeductible traditional IRA contribution in the year.
Distributions from a traditional IRA with any basis.
Roth conversion from a traditional IRA or 401(k).
Roth IRA distribution before age 59-1/2 or under the 5-year rule.

Why basis tracking matters:

Basis (nondeductible contributions) is not taxed on distribution.
Pro-rata rule: each distribution is part taxable (growth + deductible contributions) and part non-taxable (basis).
Without the Form 8606 trail, the IRS assumes everything is taxable.

FEIE users often make nondeductible IRA contributions (because FEIE reduces earned income, the full phase-out of the deduction is triggered). Form 8606 tracks the basis.

Penalty for failure to file: $50. But failing to track basis costs more because you pay tax twice on the same money.

What is Form 8962, and when do expats file it?

Form 8962 reconciles the Premium Tax Credit (PTC) received through the Health Insurance Marketplace against what you were eligible for based on income. Expats rarely file it because they’re not eligible for PTC while abroad under PPT or BFR (IRS: Form 8962).

When expats encounter Form 8962:

Moving year: Marketplace coverage for part of the year before moving abroad.
Return year: Marketplace coverage for part of the year after returning to the U.S.
Dependents remaining in the U.S.: who had Marketplace coverage.
Non-qualifying year: expat who didn’t meet PPT or BFR but had Marketplace coverage.

Expats typically claim “exemption” rather than PTC:

PPT/BFR qualifiers are treated as having minimum essential coverage.
No shared responsibility payment owed for months abroad.
Form 1040 checkbox indicates full-year coverage.

The Marketplace sends Form 1095-A for coverage received; use this to complete Form 8962.

Advance Premium Tax Credit (APTC) overpayments may need to be repaid if your actual income exceeded the Marketplace estimate. Returning expats with high foreign income before their return may face unexpected repayments.

What Is Form 8960 and When Do Expats Owe the Net Investment Income Tax?

Form 8960 calculates the 3.8% Net Investment Income Tax (NIIT) on investment income when your modified adjusted gross income exceeds $200,000 (single), $250,000 (MFJ), or $125,000 (MFS). For expats, income excluded by the FEIE is added back to MAGI for the NIIT threshold, meaning you can owe NIIT even if your taxable income is zero (IRS: Questions and Answers on the Net Investment Income Tax).

Example: An expat earns $130,000 in wages (fully excluded by FEIE) and $80,000 in investment income. MAGI = $130,000 (FEIE add-back) + $80,000 = $210,000. This exceeds the $200,000 single threshold by $10,000. NIIT = 3.8% x lesser of $80,000 (NII) or $10,000 (excess MAGI) = $380.

Where to report:

Form 8960 calculates the NIIT and flows to Schedule 2, line 18 of Form 1040
FTC does NOT offset NIIT: the Foreign Tax Credit on Form 1116 offsets regular income tax only, not the NIIT (a separate, limited FTC for NIIT exists under proposed regulations, but is complex)

When Do I Switch from Form W-8BEN to Form W-9 After Getting a Green Card?

You switch from Form W-8BEN to Form W-9 on the day you become a U.S. resident alien. For green card holders, that is the date your green card is issued (the “lawful permanent resident” date on your card). From that date forward, you are a U.S. person for tax purposes, and any payer holding a W-8BEN for you must receive an updated W-9 (IRS: About Form W-9).

The reverse transition (U.S. person to NRA after renouncing or surrendering a green card) requires switching from a W-9 to a W-8BEN form and is equally important. Your U.S. brokerage needs the updated W-8BEN to apply the correct treaty withholding rate.

For foreign information returns (Forms 5471, 8865, and 3520), the statute of limitations does not begin until the form is filed. If you never filed it, the IRS can assess penalties indefinitely.
