Can I e-file my U.S. expat tax return if I’m filing late?
Yes. The IRS e-file system accepts the current tax year and the two prior tax years, even when filed late. Older delinquent returns and all Streamlined Filing Compliance Procedures submissions must be filed on paper to the IRS service center designated in the procedure instructions.
E-file eligibility windows:
- Current tax year: Always eligible
- One year back: Eligible via most software through roughly October the following year
- Two years back: Limited software support
- Three or more years back: Paper filing required
When paper filing is required:
- Streamlined Foreign Offshore package: Mail to Austin, Texas address with “Streamlined Foreign Offshore” at top
- Amended returns beyond 3 years back: Paper Form 1040-X
- Delinquent international information returns: Paper to IRS Ogden
Paper filing tips for expats:
- International tracked mail (DHL, FedEx Priority) to prove delivery
- Printed transmittal letter referencing all attached forms
- All forms stapled in the specified order
- Copies kept before mailing
